§ 1 general provisions

The Regulations define the rules of the Application's functioning as well as the rules and mannerthe provision of electronic services through it, intended formobile devices with the Android or iOS operating system.

§ 2 Definitions

The following terms used in the Regulations should be understood as follows:
1) Personal data administrator - Multic Technology sp.z o.o. with registered officeat ul. Legionów 28-30 43-300 Bielsko-Biała;
2) Application - a computer program with the registered name Telpark belonging toto Multic intended for installation by the User on devicesportable (e.g. mobile phone, tablet), through whichThe user can control the automation of parking lots equipped with the Telpark SystemPremium if the Parking Administrator has entered the User's telephone numberto the System and authorized it to use by entering this number onwhitelist or by subscription;
3) System Telpark Premium hereinafter System - is an IT program located on the System Administrators servers to which the AdministratorThe car park has access via a web browser, via the Internet;
4) Parking Administrator - a person or company that has received access tosystem from the System Administrator to control devicesinstalled in his parking lot;
5) Login details - data with which the User logs in toApplication accounts, i.e. phone number and password;
6) System Administrator - Multic employee or team of employeesdelegated to manage the Telpark Premium System;
7) Multic - Multic Technology sp.z o.o.with headquarters at 28-30 Legionów Street43-300 Bielsko-Biała, registered in the National Business RegisterCourt Register by the District Court for the capital city of Warsaw inWarsaw, XII Commercial Department of the National Court Register, under the numberKRS: 0000359954, NIP: 547-212-28-94, REGON: 241600041;
8) Account - an account created by the User through the Application,containing User's phone number and password;
9) Complaint - a User speech directed to Multic in whichUser has reservations regarding services provided by Multicregarding the Application;
10) Provision of services by electronic means - provision of services withoutsimultaneous presence of parties (at a distance), by transmitting data toindividual request of a recipient, sent and received viaelectronic processing equipment including digital compression andstoring data that is entirely transmitted, received ortransmitted via a telecommunications network within the meaning of the Act ofJuly 16, 2004 - Telecommunications Law (i.e., Journal of Laws of 2014, item 243,as amended);
11) Services - services provided by Multic via electronic means with the help ofApplication;
12) User - a natural person who is a consumer within the meaning of Article 221Of the Civil Code, having full legal capacity, whichhas gained access to the Application;
13) Regulations - these regulations of the Telpark mobile application.

§ 3 Using the Application

1. The owner and entity managing the Application is Multic.
2. An application is software that aims to provide access toThe user can efficiently control parking automatics.
3. To use the Service, it is necessary to have a mobile device,as well as the connection of the mobile device to the Internet. Connection costswith the Internet shall be borne by the User, in accordance with the contracts concluded byUser with a telecommunications operator.
4. For the correct and effective use of the Mobile Application,it is necessary for the User to use at least the devicebased on the operating system Android 4.0.3 and newer, or iOS 12.1.1 andLater.
5. The mobile application can be downloaded using Google online storesPlay and the App Store.
6. Parking automation control service as part of the mobile applicationTelpark is free for the User and access to it takes placethrough the given mobile device.
7. Costs of data transmission required for download, installation, commissioningand the use of the Application is borne by the User on its ownbased on contracts concluded with telecommunications operators. Multic nois responsible for the amount of fees charged foruse of data transmission necessary to use the Application.
8. Multic shall not be liable for non-performance or improperrendering of services by telecommunications operators with which the Userhas concluded contracts.
9. Multic is not responsible for failure to act or improperoperation of the Mobile Application on a device that does not meet the requirementsTechnical.
10. Multic shall not be liable for non-performance or improperperformance of services by Parking Administrators.

§ 4 Registration process

1. By completing the registration procedure in the Mobile Application,which results in the creation of an Account, the User warrants and represents thathas read and accepted the content of the Regulations and undertakes toObservance.
2. The User, by registering in the Application, also agrees to:

§ 5 Application operation rules

1. Creating an Account requires the User to provide a phone number andPasswords.
2. The user may remove the application from the device at any timemobile. Removing the Application does not mean deleting the account,containing the User's telephone number. To delete a User's account,The user should contact the Parking Administrator and atrules based on the System, and especially on the rules in force ongiven parking details determined by the Parking Administrator, the User maydelete your Account. Deleting an Application is tantamount to a solutioncontracts for the provision of Telpark mobile application services by electronic means,however, he does not terminate the contract concluded with the Administrator by the UserParking lot or with the System Administrator.
3. The User may uninstall the Application from the device at any timemobile, and uninstalling the Application is not tantamount todeleting the Account.
4. Services provided by the Application are provided 24 hours a day,seven days a week.
5. In relation to the availability referred to in paragraph 4 above, exceptionthey may be failures that limit Users' access to the Application.

§ 6 Intellectual Property Rights

1. All rights, including copyright, regarding the contentApplications are the property of Multic.
2. Trademarks, logos, names and images displayed in the Applicationmobile are registered or unregistered trademarks belonging toto Multic.

§ 7 Protection of personal data

1. The administrator of Users' personal data is Multic Technologysp.z o.o.with headquarters at 28-30 Legionów Street 43-300 Bielsko-Biała.
2. The personal data administrator processes Users' data for the purpose of andto the extent necessary to provide the Services.
3. Providing personal data by the User is voluntary.The personal data administrator also informs the User thatThe User has the right to access User's personal data, theircorrecting as well as withdrawing granted consents to data processingUser's personal data in accordance with the Act of 10 May 2018 on protectionpersonal data (Journal of Laws of 2018, item 1000)

§ 8 Complaints and out-of-court dispute resolution

1. The User is entitled to submit Multic complaints regardingServices provided.
2. The User may lodge Complaints regarding the operation of the Applicationin electronic form - to
3. In order for the complaint to be processed efficiently by Multic Usershould present in the Complaint a description of the facts of the case,disclaimer (s) regarding services provided throughApplication as well as indicate what the User requests from Multic.
4. Multic reserves that all irregularities regardingthe functioning of the car park and related fees, chargeParking Administrator, not Multic.

§ 9 Final provisions

1. The Regulations in this wording shall apply from May 1, 2019.
